Product Warranty and Sales Policy

Warranty Policy

We warrant that all products manufactured and sold by us are free from defects in material and workmanship and those products of our design are fit for the purpose intended by us when properly installed and wired according to instructions and national, state and local codes and kept free of dirt and rust.

All products manufactured or sold by us are warranted for a period of twelve (12) months after the product is first put into use, or not more than fourteen (14) months after date of shipment, whichever shall expire first, Provided that written notice has been given us within thirty (30) days after first discovery of any defects.

The extend of our liability for breach of such warranty, when such is shown to our satisfaction, and the product has become impaired for the use for which it was intended by us, shall be limited to the replacement or repair of such product or part thereof, F.O.B Toronto, Canada.

APEX Automation Solutions assumes no liability for inconvenience or labor cost incurred. Goods returned without our authorization will not be accepted.


Sales Policy

Prices are subject to change without notice. No prices are guaranteed. All shipments will be made at prices prevailing at time of shipment. Errors or omissions in pricing are subject to correction.

Terms of payment
Payment for purchases made under this accord would be paid by Credit Card, T/T in advance or by an irrevocable and confirmed L/C at sight (for order not less than USD5000.00).

Arbitration and Government Law
In the event of a dispute or controversy, or differences, which may arise between parties, any claim shall be settled by arbitration. The arbitration shall take place in Toronto and under the laws of the province of Ontario, Canada Freight

All goods are invoiced EX-Works, in APEX Automation Solutions regular packing. When delivered to the transportation company the shipments become the property of the purchaser, who assumes the risk of loss or damage in transit.

We reserve the right to decline an order, in whole or in part, when the price, quantity or assortment of goods is not satisfactory to us.

Back Charges
We are not responsible for, do not authorize, and will not accept any charges for the cost of any labor or material incurred by anyone other than APEX Automation Solutions for any installation, repair, service or replacement unless incurred with our prior written consent and agreement.

Returned Goods
Any defects or errors for which we are responsible will be promptly rectified. Approval for return of merchandise must be requested of us, and when granted, the return authorization number must be displayed on all packages returned. Material found suitable for resale without reconditioning will be credited to customer’s account less a handling and reprocessing charge of 35% of the net material value. Further charges will be assessed on material requiring rework to return it to saleable condition. Outdated and obsolete products will not be accepted for return. Items manufactured to a special finish, options, size or pre-assembly configuration are considered special and are not returnable for credit. Incoming transportation charges are to be prepaid by the Buyer. Credits for material returned will have 2% deducted to cover the cash discount allowance on the original invoice.

No cancellation is acceptable, once an order is confirmed.

An extra charge will be applied to each change on any order after confirmation of order by APEX Automation Solutions.

A claim for shortages must be made within ten (10) days after receipt of material. (The original invoice number will be required.)

Product Changes
APEX Automation Solutions has the right to modify, change or discontinue any components as required.
